These Terms and Conditions govern access to and use of https://goldencabotransportation.com and the contracting of the tourist ground transport and tour services offered on it. They are issued under Mexico's Commercial Code, Federal Civil Code and Federal Consumer Protection Law. The Spanish version is the only legally binding one; this English text is a courtesy translation.
1. Provider details
The site and the services are operated by CEUR Transportation S. de R.L. de C.V., trading as Golden Cabo Transportation (the "Company", "we"), with address at Calle Huanacastle Esq. Eucalipto Mza 70 lte 1, Col. Las Veredas, CP 23436, San José del Cabo, BCS, phone (+52) 624 121 6527 and email goldencabotransportation@gmail.com.
2. Purpose
These Terms govern two distinct relationships:
- Use of the website by anyone accessing it, checking rates, using the booking assistant or the contact forms (the "User").
- Contracting of services by whoever confirms a booking (the "Client"), a relationship also governed by the confirmation or voucher issued, which forms an integral part of this contract.
3. Acceptance of these Terms
Accessing and browsing the site implies full and unreserved acceptance of these Terms and Conditions in the version published at the time of access, as well as of the Privacy Notice and the Cookie Notice, which form an integral part of this document. If you disagree with any clause, you must refrain from using the site.
Under articles 89 to 94 of Mexico's Commercial Code and article 1803 of the Federal Civil Code, consent given by electronic means has the same effect as consent given in writing. By confirming a booking you expressly agree to be bound by these Terms.
These Terms remain permanently accessible from the footer of every section of the site, so they can be consulted, saved and printed before and after booking.
4. Legal capacity
You must be 18 or older and have full legal capacity to book. Anyone booking on behalf of a group declares they have sufficient authority to bind all its members to these Terms and is jointly liable for payment.
5. Services
The Company provides private tourist ground transport in Baja California Sur, comprising:
- Transfers to and from Los Cabos International Airport (SJD) to the zones published on the site.
- Point-to-point transfers within the region.
- Tours following a published itinerary.
Services are private: the vehicle is assigned exclusively to the Client and their group. The Company reserves the right to assign the vehicle matching the declared number of passengers and luggage, and may substitute it with one of equal or greater capacity at no extra cost, which shall not be deemed a breach.
6. Booking process
- The User requests the service through the site's booking assistant, WhatsApp, phone or email, stating: date, time, flight number, airline, hotel or destination, number of passengers and special luggage.
- A request does not in itself constitute a contract: it is an offer subject to availability.
- The contract is formed when the Company issues the confirmation or voucher bearing an order number. That document evidences the service booked and its specific conditions.
- It is the Client's responsibility to check the voucher details and report any error within 24 hours of receiving it.
Flight details are essential: without them the Company cannot monitor delays or guarantee the driver is present on arrival.
7. Prices, taxes and payment
- Published prices are in US dollars (USD), are per vehicle — not per passenger — and include applicable taxes unless stated otherwise.
- Prices may change without notice; the applicable price is the one in force when the confirmation is issued, and it is honoured even if the published rate changes afterwards.
- Payment is made in cash, directly to the driver, at the start of the service, in US dollars or Mexican pesos. Any other payment method must be arranged beforehand with a Company agent when confirming the booking.
- No deposit or advance payment is required to book. Requesting or confirming a transfer incurs no charge whatsoever.
- Additional stops, extended waiting, changes of destination or detours not included in the booking incur additional charges, notified before being carried out and settled together with the service.
- Tips are not included and are at the Client's discretion.
- A Mexican tax invoice (CFDI) may be requested within the calendar month in which the service was provided, supplying the relevant tax status certificate and CFDI use code.
This site does not process online payments. There is no payment gateway, shopping cart or automated charge: neither the booking assistant nor the contact forms will ever ask you for card numbers, security codes, bank accounts or any other financial detail. If you receive a call, email or message claiming to be from Golden Cabo Transportation asking for an online payment or those details to confirm your transfer, it did not come from us: do not reply, and report it to goldencabotransportation@gmail.com.
8. Cancellations, changes and no-shows
Since booking requires no deposit or advance payment, cancelling or changing a service incurs no penalty, charge or later billing of any kind, however much notice you give. There are no refunds to process simply because nothing has been charged.
Even so, please give us at least 24 hours' notice whenever possible: each transfer reserves a vehicle and a driver exclusively, and timely notice lets us free them for another passenger.
All cancellations or changes must be requested at goldencabotransportation@gmail.com or via WhatsApp at (+52) 624 121 6527, quoting the order number, and take effect once the Company acknowledges receipt. Changes of date, time, hotel or passenger count are subject to availability and are confirmed with a new voucher.
If the passenger does not show up (no-show)
Where the passenger neither appears nor notifies us within the grace periods set out in clause 9, the service is treated as a no-show. As no payment was taken beforehand, no charge arises; the Company reserves the right to decline further bookings from anyone who repeatedly no-shows without good reason.
Cancelled, delayed or diverted flights
If the airline cancels, delays or diverts the flight, or the Client cannot travel due to force majeure, the service is rescheduled at no cost subject to availability. Let us know as soon as you can so we can reassign the vehicle to the new arrival time.
Cancellation by the Company
If the Company cancels a confirmed service for reasons attributable to it, it will inform you promptly through the contact channel you provided and, where possible, offer alternative transport at no extra cost. In the exceptional event that you had made an advance payment arranged with an agent, it will be refunded in full through the same channel you used.
9. Passenger obligations
- Punctuality. Be at the meeting point at the agreed time. The Company allows 15 minutes grace for hotel pick-ups and 60 minutes from actual landing at the airport. Once that grace period passes without the passenger appearing or notifying us, the service is treated as a no-show.
- Accurate information. Provide exact flight, hotel and passenger-count details. The Company is not liable for services not provided because of incorrect details supplied by the Client.
- Seat belts must be worn throughout the journey, as required by law.
- Conduct. Smoking, drug use and carrying illegal substances or hazardous materials in the vehicle are prohibited. The driver may refuse or interrupt the service where a passenger's condition or conduct compromises the safety of the journey or the other occupants; in that event the service is treated as delivered and gives rise to no claim.
- Damage. The Client is liable for damage caused by them or their group to the vehicle, including specialist cleaning.
- Pets. Accepted subject to notice at the time of booking and must travel in a suitable carrier. Assistance animals are always accepted at no charge.
10. Luggage
- The fare includes one checked bag and one carry-on per passenger, within standard airline dimensions.
- Bulky or special luggage — surfboards, golf clubs, wheelchairs, instruments, diving gear — must be declared when booking. Without prior declaration the Company cannot guarantee space and a larger vehicle may be required at additional cost.
- Luggage travels at its owner's risk. We recommend not leaving valuables, documents or electronic devices in the vehicle.
- Lost property. Items found are held for 30 calendar days. Return is at the Client's expense, including shipping.
11. Minors
Minors must travel accompanied by a responsible adult. If you need a child seat or booster, request it when booking, stating the child's age and weight: the Company provides it subject to availability at no additional cost unless stated otherwise. Minors count as passengers for vehicle capacity purposes.
12. Limitation of liability
Vehicles carry the civil and passenger liability insurance required by the regulations applicable to tourist transport. The Company's liability towards the Client is governed by that cover and by applicable Mexican law.
The Company is not liable for:
- Delays, detours or interruptions caused by fortuitous events or force majeure: weather, roadblocks, demonstrations, road closures, official operations, third-party accidents, strikes or extraordinary traffic conditions.
- Missed flights where the Client did not allow a reasonable time margin. We recommend booking the airport transfer at least 3 hours before departure on international flights.
- Indirect or consequential damages or loss of profit.
- Services the Client contracts with third parties — hotels, airlines, restaurants, guides, activities — even where suggested by the Company.
Nothing in this clause limits the non-waivable rights Mexican law grants consumers.
13. Personal data and information collected through use of the site
Processing of personal data is governed by our Privacy Notice, which forms an integral part of these Terms and which we recommend reading before continuing to browse.
By accessing and browsing this site, the User acknowledges and accepts that the Company automatically collects the information described in section 2.2 of the Privacy Notice, namely: IP address, approximate geographic location derived from it (country, state, city and, where applicable, postal code), technical device data — device type, operating system, browser and language — and browsing data — pages viewed, date and time, and the site or campaign of origin — for the purposes stated there, including the statistics and commercial analysis described in section 5 of that Notice.
That acceptance operates on the following terms, which the User declares they understand:
- For necessary purposes — site operation and security, fraud prevention and basic audience measurement using the pseudonymised IP address — consent is understood to be given tacitly, under article 8 of the Federal Law on the Protection of Personal Data Held by Private Parties, the Privacy Notice having been made available to the User and no objection having been raised.
- For secondary purposes — retaining the IP address in the clear, determining approximate geographic location, building commercial profiles, marketing and prospecting — processing requires the User's express consent, given through the cookie banner. Until it is given, those purposes remain disabled.
- The User may object or withdraw consent at any time, free of charge and with no consequence for any service already booked, through the cookie preferences panel or by writing to goldencabotransportation@gmail.com.
Location is not your home address. Location derived from an IP address is approximate and corresponds to the internet connection point, not to your home address or exact position. The Company does not collect the User's home address by virtue of browsing: the only address requested is the pick-up or drop-off location of the transfer, and only when the User chooses to book.
14. Intellectual property
All site content — text, photographs, illustrations, logos, trademarks, design, source code, structure and databases — belongs to the Company or to third parties who have authorised its use, and is protected by Mexico's Federal Law for the Protection of Industrial Property and Federal Copyright Law.
Its reproduction, distribution, public communication, transformation or extraction, in whole or in part, without prior written authorisation is prohibited. Accessing the site grants no licence over that content.
15. Permitted use of the site
The User agrees to use the site in accordance with the law, good faith and these Terms. The following are prohibited:
- Using automated means — bots, scrapers, spiders — to extract content or flood the forms, and circumventing the site's anti-abuse mechanisms.
- Introducing malicious code or attempting to access restricted areas, other people's accounts or the admin panel.
- Making false or fraudulent bookings, or bookings in third parties' names without their authorisation.
- Impersonating the Company or its staff, or holding oneself out as its representative.
- Any conduct that degrades the site's operation or affects other users.
The Company may restrict access, cancel bookings and pursue any applicable legal action in response to such conduct.
16. Third-party links and services
The site may contain links to external platforms — WhatsApp, Messenger, maps, social networks. The Company neither controls those sites nor answers for their content, policies or practices. Access to them is at the User's own risk and subject to their own terms.
17. Complaints, clarifications and PROFECO
For any complaint or clarification, write to goldencabotransportation@gmail.com or call (+52) 624 121 6527, quoting your order number. We undertake to acknowledge receipt within a maximum of 5 business days and to provide a substantive reply within the following 15 business days.
Without prejudice to the above, the Client may approach Mexico's consumer protection agency (PROFECO) through profeco.gob.mx, its consumer helpline, or the office covering their address.
18. Amendments and severability
The Company may amend these Terms at any time. The version applicable to each booking is the one published when the confirmation was issued, and that version is unaffected by later changes. Amendments are published on this page with an updated version number, currently 2026-08-13.
If any clause is declared void or unenforceable by a competent authority, that declaration shall not affect the validity of the remaining clauses, which continue in full force.
19. Governing law and jurisdiction
These Terms are governed by the laws of the United Mexican States. For their interpretation and performance, the parties submit to the applicable laws and to the jurisdiction of the competent courts of San José del Cabo, Baja California Sur, waiving any other jurisdiction that might correspond to them by reason of their present or future domiciles.
In consumer relationships, this clause does not deprive the Client of access to the jurisdiction or the PROFECO conciliation procedure that the law affords them.
